WARMCO Terms of Service (New Zealand)

Welcome to WARMCO. The terms “we”, “us”, and “our” refer to WARMCO. WARMCO operates this website and online store, including all related information, content, features, tools, products, and services (the “Services”). WARMCO is powered by Shopify, which enables us to provide the Services to you.

By accessing or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Services.

1. Access and Account

By using the Services, you confirm you are at least the age of majority in New Zealand and that any minors using the Services do so with your permission.

To use the Services, you may be required to provide accurate and current information, including your email address, billing details, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Our Products

WARMCO sells heated clothing containing electronic components. Product colours, appearance, and materials may vary depending on your device settings.

We do not guarantee that any product will meet your expectations or appear exactly as displayed online. Product descriptions, specifications, and availability may change at any time without notice. We may limit product quantities or discontinue products at our discretion.

3. Orders

Placing an order constitutes an offer to purchase. WARMCO may accept or decline any order at its discretion. Orders are accepted once payment is processed and WARMCO confirms acceptance.

Please review your order carefully before submitting, as cancellations may not be possible once accepted.

All purchases are subject to our Returns & Refund Policy.

You confirm that all purchases are for personal use and not for resale or export.

4. Prices and Billing

Prices may change without notice. The price at checkout is the price in effect at the time of purchase. Prices do not include shipping, taxes, or duties unless stated.

You agree to provide accurate payment information and confirm you are authorised to use the payment method provided.

5. Shipping and Delivery

Delivery timeframes are estimates only. WARMCO is not liable for delays caused by carriers, customs, or events outside our control.

Once an order is handed to the carrier, risk of loss transfers to you.

6. Heated Clothing Safety & Use

WARMCO heated garments contain electronic heating elements, wiring, and connectors. By purchasing and using these products, you agree to:

• Use only certified 5V power banks

• Never use damaged, swollen, or unsafe power banks

• Follow all care instructions, including disconnecting the power bank before washing

• Avoid modifying wiring, heating pads, or connectors

• Stop using the garment immediately if any malfunction occurs

Improper use may result in damage or void your warranty.

WARMCO is not liable for damage caused by misuse, incorrect voltage, unauthorised modifications, or unsafe power banks.

7. Intellectual Property

All content on the Services—including trademarks, text, images, graphics, and layouts—is owned by WARMCO or its licensors. You may use the Services for personal, non‑commercial purposes only.

You may not copy, reproduce, distribute, modify, or create derivative works without written permission.

8. Optional Tools

Third‑party tools may be available through the Services. These are provided “as is” without warranties. Your use of third‑party tools is at your own risk.

9. Third‑Party Links

The Services may contain links to third‑party websites. WARMCO is not responsible for the content, accuracy, or policies of third‑party sites. Any transactions with third parties are solely between you and the third party.

10. Relationship with Shopify

WARMCO is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with WARMCO. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and WARMCO, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with WARMCO.

Personal information collected through the Services is governed by our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you acknowledge you have read both policies.

You agree to indemnify WARMCO and Shopify against claims arising from your breach of these Terms or misuse of the Services.
